Chief Justice John Roberts said the court has âmade mistakesâ but that criticisms shouldnât be based on âad hominemâ attacks.
The U.S. Supreme Courtâs chief justice on Monday told an event that criticism of the court should be relegated to its decisions and not the nine justices themselves.
While speaking at Washingtonâs Georgetown University, Chief Justice John Roberts said that the Supreme Court âhas obviously made mistakes throughout its history, and those should be criticized, so long as it is in terms of the decision.â
Roberts said that criticism of the highest court should not be based on âad hominemâ arguments or attacks âagainst the justicesâ themselves, referring to the logical fallacy where an argument is dismissed based on the character or background of the individual making that claim.
âI just think that doesnât do any good. The harshest critics are usually colleagues, if itâs the sort of thing where there are dissents. So itâs something weâre used to,â he continued. âAnd again, itâs a good thing. Weâre not immune from any criticism. And there are many, many instances in our history where itâs been effective over time in leading to a better result.â
The comment from Roberts marks the third time in nearly as many months in response to criticism about the Supreme Court.
âFor more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision,â Roberts said in a statement provided to The Epoch Times at the time. âThe normal appellate review process exists for that purpose.â
Following U.S. District Judge James Boasbergâs initial ruling against the administrationâs use of the 1798 law to deport accused gang members, Trump wrote that the judge wasnât elected as president.
Trump hasnât been critical of the Supreme Court and has indicated that he will follow orders from any court. Since the start of his administration, numerous lawsuits have been filed against his administration, particularly in relation to his immigration enforcement, spending cuts, and efforts to downsize and reshape the federal government.
The judicial branchâs independence is âthe only real political-science innovation in our Constitution,â Roberts said. Elaborating, he said that âin our Constitution ⌠the judiciary is a co-equal branch of government, separate from the others, with the authority to interpret the Constitution as law and strike down ⌠acts of Congress or acts of the president.â
âAnd that innovation doesnât work if ⌠the judiciary is not independent. Its job is to ⌠check the excesses of Congress or of the executive, and that does require a degree of independence,â he said.
In his recent remarks and written statement, Roberts did not mention Trump, nor did he mention any other elected official.
