The GOP lawmakers seek âall documents and communications, including audio and video recordings, related to the special counselâs interview of President Biden.â
House Republicans have requested transcripts and tapes of President Joe Bidenâs interview with Special Counsel Robert Hurâs office after a report found the president had âwillfullyâ retained classified documents.
House Oversight Chair James Comer (R-Ky.), House Judiciary Chair Jim Jordan (R-Ohio), and House Ways and Means Chair Jason Smith (R-Mo.) said the records are required for âinvestigatory purposes.â
âAs detailed in Mr. Hurâs report, classified materials found at both President Bidenâs residence in Wilmington, Delaware, and the Penn Biden Center for Diplomacy and Global Engagement include documents related to China and Ukraine,â the letter reads.
In the letter, the GOP lawmakers said âthere is concern that President Biden may have retained sensitive documents related to specific countries involving his familyâs foreign business dealings.â
âFurther, we seek to understand whether the White House or President Bidenâs personal attorneys placed any limitations or scoping restrictions during the interview that would have precluded a line of inquiry regarding evidence (emails, text messages, or witness statements) directly linking the president to troublesome foreign payments.â
This request is also part of the Judiciary Committeeâs âongoing oversight of the Departmentâs commitment to impartial justice and its handling of the investigation and prosecution of President Bidenâs presumptive opponent, Donald J. Trump, in the November 2024 presidential election,â according to the letter.
âAlthough Mr. Hur reasoned that President Bidenâs presentation âas a sympathetic, well-meaning, elderly man with a poor memoryâ who âdid not remember when he was vice presidentâ or âwhen his son Beau diedâ posed challenges to proving the presidentâs guilt beyond a reasonable doubt, the report concluded that the Departmentâs principles of prosecution weighed against prosecution because the Department has not prosecuted a former president or vice president for mishandling classified documents from his own administration.
âThe one âexceptionâ to the Departmentâs principles of prosecution, as Mr. Hur noted, âis former President Trump.â This speaks volumes about the Departmentâs commitment to evenhanded justice,â they stated.
The GOP lawmakers requested âall documents and communications, including audio and video recordings, related to the special counselâs interview of President Biden.â
They also requested documents related to President Bidenâs 2015 call with then-Ukrainian Prime Minister Arseniy Yatsenyuk and Mr. Hurâs interview with the presidentâs book ghostwriter, Mark Zwonitzer.
Special Counselâs Report
The special counselâs 388-page report found that President Biden âwillfully retained and disclosed classified materials after his vice presidency when he was a private citizen.â
These materials include âmarked classified documents about military and foreign policy in Afghanistan, and notebooks containing Mr. Bidenâs handwritten entries about issues of national security and foreign policy implicating sensitive intelligence sources and methods.â
However, the special counsel decided not to prosecute the president due to insufficient evidence to establish his guilt âbeyond a reasonable doubtâ and the presidentâs âpoor memory.â
